NEW JERSEY DRIVERS TAKE ALCOTEST AND GET SURPRISING RESULTS AT STAGED HOLIDAY PARTY

The Alcotest reading (still colloquially referred to as the “breath” or “breathalyzer” test) often comes in to play as a major flash point during the discovery process. It’s a frequent topic here at our blog as a direct result, and the defendant’s blood alcohol content (BAC) reading can affect sentencing or even whether he or she is guilty of the substantive crime. You can imagine the extent to which the December Christmas party circuit brings these issues front-and-center for New Jersey motorists who never previously pondered the scientific accuracy of this oft-misunderstood instrument. This week Mike Halfacre, the Director of the Division of Alcoholic Beverage Control which is part of the Office of the Attorney General in New Jersey’s Department of Law and Public Safety, hosted a unique social experiment on NBC’s Today Show. Several New Jersey residents were invited to a party (with full knowledge that they’d have designated drivers or cabs to get home) to drink alcoholic beverages freely and then subject themselves to a state trooper administering an Alcotest.  Many participants were surprised by their readings:
